Terms of Service

These Terms of Service ("Terms") govern your use of Moments Writer, a service of funeralOne, LLC, 407 East Fort Street, Suite 300, Detroit, MI 48226, United States ("funeralOne," "we," "us," or "our"). Moments Writer includes the websites and applications at momentswriter.ai and app.momentswriter.com (together, the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy.

1. The Service

Moments Writer helps funeral homes write, edit, and share obituaries and related memorial content with the families they serve. The Service includes AI-assisted writing tools, collaboration features, and notifications by email, text message, and in-app message.

2. Who may use the Service

Funeral home professionals use the Service under a workspace account provided through their funeral home's agreement with funeralOne. Family members and friends participate by personal invitation from a funeral home, at no charge, and may use the Service only to view and contribute to the obituary they were invited to. You must be at least 18 years old to create an account or accept an invitation.

3. Accounts and invitation links

You are responsible for the accuracy of the information you provide and for keeping your sign-in credentials confidential. Invitation links are personal to the invited recipient: do not forward or share them. Invitation links expire (currently 30 days after issue), may be revoked by the funeral home at any time, and stop working when revoked. We may suspend access that we reasonably believe is unauthorized or misused.

4. Your content

You and your funeral home retain ownership of the content you create or upload — obituary text, edits, suggestions, notes, photos, and other media ("Content"). You grant funeralOne a limited license to host, process, display, and transmit Content solely to operate and improve the Service. You are responsible for having the rights to the Content you provide and for its accuracy. We may remove Content that violates these Terms or applicable law.

5. AI-assisted writing

The Service uses artificial intelligence to help draft and edit obituary text. AI-generated drafts may contain errors or inaccuracies. You are responsible for reviewing and approving all Content before it is finalized or published. The Service produces drafts for your review; it does not publish anything without human approval.

6. Acceptable use

You agree not to misuse the Service, including by: attempting to access another person's account or data; probing or breaching security measures; uploading unlawful, infringing, or abusive material; using the Service to send unsolicited communications; or interfering with the operation of the Service.

7. SMS terms (text messaging program)

Moments Writer sends transactional text messages: obituary collaboration invitations and account activity alerts. By providing a phone number — or by being enrolled by the funeral home serving your family, which confirms at entry that you expect to be contacted — you consent to receive these messages.

  1. Message frequency varies with account activity. Typical recipients receive 2–6 messages per funeral service.
  2. Message and data rates may apply, depending on your carrier plan.
  3. To opt out at any time, reply STOP to any message. You will receive a single confirmation message and no further texts.

  5. Wireless carriers are not liable for delayed or undelivered messages.
  6. Phone numbers and SMS consent records are handled as described in our Privacy Policy and are never shared with third parties for marketing.

8. Email communications

We send transactional emails needed to operate the Service, such as invitations, account alerts, and security notices. Replies to invitation emails are directed to the funeral home staff member who sent the invitation.

9. Third-party services

The Service relies on third-party providers (for example, for authentication, hosting, and message delivery). Their availability is outside our control, and their services are governed by their own terms.

10. Fees

Access for invited family members is free. Funeral home access is provided under the commercial agreement between funeralOne and the funeral home.

11. Termination

You may stop using the Service at any time. Funeral homes control access to their workspace, including revoking invitations. We may suspend or terminate access for violation of these Terms, for risk to the Service or its users, or as required by law. Sections 4, 5, and 12–15 survive termination.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CONTENT (INCLUDING AI-GENERATED DRAFTS) WILL BE ACCURATE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNERALONE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM OR RELATED TO THE SERVICE. FUNERALONE'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS (US $100) OR THE AMOUNTS PAID TO FUNERALONE FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

14. Indemnification

If you use the Service on behalf of a funeral home or other organization, that organization agrees to indemnify funeralOne against claims arising from its Content or its violation of these Terms.

15. Governing law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. Courts located in Wayne County, Michigan have exclusive jurisdiction over disputes arising from these Terms, and each party consents to their jurisdiction.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date, and, for material changes, provide additional notice within the Service. Continued use of the Service after changes take effect constitutes acceptance.
